Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FaithNudge website, dashboard, mobile application, and related services (collectively, the “Services”) operated by FaithNudge (“we,” “us,” or “our”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Eligibility
You must be at least 18 years of age to create an account and use our Services. By creating an account, you represent that you have the legal authority to enter into these Terms on behalf of yourself or the organization you represent.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
- Church administrators are responsible for managing access and permissions within their organization.
3. Use of Services
3.1 Permitted Use
FaithNudge is designed for churches, religious organizations, and nonprofits to manage their operations, engage their congregations, and facilitate community. You may use the Services for these intended purposes in accordance with these Terms.
3.2 Prohibited Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation
- Upload, transmit, or distribute any content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to gain unauthorized access to other users' accounts or any part of our systems
- Use the Services to send unsolicited communications (spam) or commercial solicitations unrelated to your church's legitimate activities
- Reverse engineer, decompile, or disassemble any part of the Services
- Interfere with or disrupt the integrity or performance of the Services
- Scrape, harvest, or collect information from the Services using automated means without our prior written consent
- Resell, sublicense, or redistribute the Services to third parties
4. Church Administrator Responsibilities
If you are an administrator of a church or organization on FaithNudge, you are responsible for:
- Ensuring you have the appropriate consent and legal basis to enter member information into the system
- Managing access controls and permissions for your organization's staff and volunteers
- Ensuring your use of communication tools (email, SMS, push notifications) complies with applicable laws, including anti-spam legislation
- Properly handling sensitive member information in accordance with your privacy obligations
- Maintaining accurate records of your organization's financial transactions for tax and regulatory purposes
5. Content
5.1 Your Content
You retain ownership of all content you upload, submit, or create through the Services, including but not limited to sermon recordings, images, member data, event details, and website content (“Your Content”).
By uploading content to the Services, you grant us a limited, non-exclusive license to use, store, process, and display Your Content solely as necessary to provide and improve the Services. For sermon content, this includes processing by our AI systems to generate interactive activities for your congregation.
5.2 AI-Generated Content
Our AI features generate activities, quizzes, devotionals, and other content (“Generated Content”) based on your sermon uploads. You are responsible for reviewing Generated Content before it is shared with your congregation. While we strive for accuracy and appropriateness, AI-generated content may occasionally contain errors or require adjustments.
5.3 Church Websites
When you use our website builder to create a church website, you are responsible for all content published on that site. We may remove content that violates these Terms or applicable law.
6. Financial Services and Giving
6.1 Payment Processing
Online giving and donation processing is provided through our integration with Stripe. By using the giving features, you also agree to Stripe's terms of service and privacy policy.
6.2 Church Obligations
Churches using the giving features are responsible for:
- Completing and maintaining their Stripe Express account setup, including identity verification
- Ensuring compliance with all applicable tax laws and nonprofit regulations
- Issuing appropriate tax receipts and donation acknowledgment letters to donors
- Properly managing and allocating funds received through the platform
6.3 Donor Rights
Donors may request refunds by contacting the church directly. FaithNudge does not control how churches allocate donated funds and is not responsible for church-level financial decisions.
7. Pricing
FaithNudge is currently offered free of charge. We reserve the right to introduce paid features or plans in the future. If we do, we will provide reasonable advance notice, and free-tier functionality will remain available.
8. Intellectual Property
The Services, including all software, design, trademarks, and documentation, are owned by FaithNudge and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written consent.
9. SMS Messaging Program
9.1 Program Name
FaithNudge SMS Notifications.
9.2 Program Description
The FaithNudge SMS Notifications program allows churches and organizations using FaithNudge to send text messages to members and attendees who have opted in. Messages may include event reminders, check-in notifications, service announcements, prayer requests, giving receipts, sermon activity prompts, account verification codes, and other communications related to your church's activities and your use of the Services.
9.3 Opt-In
By providing your mobile number and opting in within the FaithNudge app, dashboard, or a church's registration form, you consent to receive SMS messages from FaithNudge and from the church or organization you are associated with. Consent is not a condition of purchase or of using any non-SMS portion of the Services.
9.4 Message Frequency
Message frequency varies based on your church's activity and the notification preferences you select. You may receive recurring messages, with frequency typically ranging from a few messages per week to several messages per day during active events or campaigns.
9.5 Message and Data Rates
Message and data rates may apply. Standard messaging rates from your wireless carrier apply to all messages sent and received. Check with your mobile carrier for details about your messaging plan.
9.6 Opt-Out Instructions
You can cancel the SMS service at any time by texting STOP to any message you receive from us. After you send STOP, we will send you a confirmation message and you will no longer receive SMS messages from that program. If you want to resume receiving messages, you can sign up again as you did the first time and we will start sending SMS messages to you again.
9.7 Help

9.8 Supported Carriers
Carriers are not liable for delayed or undelivered messages. The SMS program is available on most major U.S. wireless carriers, but delivery is not guaranteed and may be affected by carrier outages or device limitations.
9.9 Privacy
Information collected for SMS messaging, including your phone number and opt-in records, is handled in accordance with our Privacy Policy. We do not share your SMS opt-in information or phone number with third parties or affiliates for marketing or promotional purposes. No mobile information will be shared with third party/affiliates for marketing or promotional purposes.

10. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Services will be uninterrupted, timely, secure, or error-free
- AI-generated content will be accurate, complete, or appropriate for your specific theological context
- The Services will meet all of your specific requirements
- Any defects in the Services will be corrected
12. Limitation of Liability
To the maximum extent permitted by law, FaithNudge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the Services
- Unauthorized access to or alteration of your data
- Errors or inaccuracies in AI-generated content
- Any third-party conduct or content on the Services
- Issues with payment processing through third-party providers
13. Indemnification
You agree to indemnify and hold harmless FaithNudge, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
14. Termination
- You may stop using the Services and delete your account at any time.
- We may suspend or terminate your access to the Services if you violate these Terms or if required by law.
- Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days following account deletion, after which it will be permanently removed.
- You may export your data prior to account deletion using our data export features.
15. Modifications to the Services
We reserve the right to modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable notice of material changes when possible.
16. Changes to These Terms
We may revise these Terms from time to time. The most current version will be posted on our website with the “Last updated” date. Material changes will be communicated through the Services or via email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration, except where prohibited by law.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
